What is trial work?
Trial work is not an employment relationship, but rather a trial work placement. Thus, both parties do not conclude an employment contract.
The purpose of trial shift is for Flink and the applicant to get to know each other without obligation and to find out whether both can imagine working together in the future.
Written agreement
Prior to any trial work, the following agreement must be completed and signed with the applicant (currently in German only):
What to consider
Duration of the trial work period
The period of trial work may last only a few days, maximum one week (Monday to Friday). As a rule, a so-called "trial day" should suffice. Here, the applicant looks at potential future areas of responsibility and gets to know the other employees.
About the trial shift
Flink holds no decisional authority towards the applicant during the probationary period with respect to the location, time and content of the tasks. The applicant should at most be assigned smaller, partial tasks. Thus, for example, no independent delivery of groceries by e-bike should take place during the trial work period. Otherwise, there is a risk that a permanent employment contract will be concluded.
The applicant should not wear work clothes and should arrange their own break times independently.
Remuneration issues
For the trial work period, Flink does not pay the applicant any salary. However, Flink can pay a voluntary expense allowance to compensate for travel costs or costs for meals, for example.
Insurance issues
As a rule, Flink does not have to report the applicant to the tax office or the social security institutions. There is also no legal obligation to report to the employers' liability insurance association.
Whether the applicant is protected by the statutory accident insurance or not depends on each individual case. Therefore, Flink points out that, in our opinion, there is in principle no insurance coverage and the applicant must provide a suitable insurance coverage themselves. However, an insurance coverage under the statutory accident insurance can exist if the applicant is registered as a job seeker and performs the trial work period under the Employment Agency.
